The judge in the lawsuit by former Greeneville Assistant Police Chief Mike Crum against the Town of Greeneville has been put on hold while the court considers a Motion for Summary Judgement.
In filings last week, both sides said that a settlement is unlikely, and both sides were ready for a June trial. However, attorneys for both sides requested the court put the trial on hold while the judge considers a motion filed by the Town of Greeneville.
In January, the Town asked for a summary judgement, which asked the court to rule in favor of the town based on the merits of the case and as a matter of law. The judge has not ruled on that motion.
In the request for the stay, both sides agreed that given the approaching trial date, and the work needed to prepare for that trial, it would be in the best interest of all parties to put the proceedings on hold until the judge rules on the motion. They also ask that even if the judge denies the motion, a delay in the trial date would be appropriate to allow both sides time to prepare.
According to the complaint filed by Crum, the Town of Greeneville acted in disregard to his rights secured under the constitution. It also states the termination injured his compensation and benefits, caused loss in reputation and respect, loss of career opportunities, embarrassment, humiliation and mental anguish.
